Chief Magistrate Anderson is part of that original operation too. She oversees the pursuit and detention of the escapees, and she's working alongside Moreau while this system is functioning exactly as intended.
That's important to remember when her role changes later. We meet her as somebody in charge of enforcement. The problems in Genosha aren't hidden from every person who has the authority to stop them.
The original arc ends with the X-Men rescuing their people, forcing Wipeout to restore Wolverine and Rogue's powers, and destroying the Citadel. Philip and Jenny leave with them. But that rescue doesn't dismantle everything Genosha has built.
The X-Men can win the immediate fight and get people out. There's still a country full of people whose lives are controlled by the system they've just fought their way through.
Even afterward, they pursue Philip and Jenny in New York in #259. Jenny discovers that her conditioning still makes it difficult to resist Magistrate orders, and Colossus helps them. Then Anderson turns up with Genosha’s foreign minister in #262 to press their claim through American officials. They can pursue somebody on the street and then try to make handing that person over sound like a matter of international cooperation.
