When Genosha comes into the story in Uncanny X-Men #235, it presents itself as a successful, prosperous country. Then you start seeing what that prosperity depends on.
Mutants are being used as slave labor. The government takes their abilities and puts them to work for the country, while the people benefiting from it get to carry on with their lives. Genosha even promotes itself as a place of freedom and opportunity. Apparently that freedom has a pretty substantial exception.
That gives the Magistrates a different kind of backing from a group that has to hide what it's doing. They have uniforms, facilities, weapons, and a government behind them. If a mutant tries to escape, the authorities treat getting that person back as legitimate business. The people running things have already decided whose freedom counts.
